Welcome to Muslims After Midnight ("we," "our," or "us"). By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Muslims After Midnight.

2. Description of Service

Muslims After Midnight is a community platform designed to help Night Owls in Muslim connect for platonic friendships only. Our service includes:

• Profile creation and discovery
• Messaging and community features
• Premium membership with enhanced features
• Public community chat

This is NOT a dating platform. Romantic or sexual content is strictly prohibited.

3. Eligibility & Age Verification

Age Requirement: You must be at least 18 years old to use our services. This is non-negotiable.

By registering, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into this agreement
• You are not prohibited from using our services under applicable law

We reserve the right to verify your age at any time and may require additional verification.

4. Account Registration

To create an account, you must:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Choose a strong, unique password
• Accept our Terms of Service and Privacy Policy

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

• Impersonation: No pretending to be someone else
• Automated Access: No bots, crawlers, or automated access without permission

6. User-Generated Content

You retain ownership of content you create and share on our platform.

By posting content, you:

• Grant us a non-exclusive, royalty-free license to use, display, and distribute it
• Represent that you own or have the rights to post such content
• Agree that your content may be visible to other users

We reserve the right to remove content that violates these Terms.

7. Premium Membership

Premium membership ("Night Owl Premium") is a paid subscription service providing enhanced features:

• Private messaging
• See who viewed your profile
• See who liked you
• Ad-free experience
• Priority placement in search results

Subscription Terms:

• Current rate: $19.99/month
• Billed monthly through Stripe (secure payment processor)
• Cancel anytime from your account settings
• Premium features end when subscription ends
• No partial refunds for unused time

8. Refund Policy

We offer refunds within 7 days of purchase if you experience technical issues that we cannot resolve.

To request a refund, contact us at support@muslimsaftermidnight.com with:

• Your account email
• Description of the technical issue
• Screenshots if applicable

Refunds for change of mind are not offered.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee that:

• Our services will be uninterrupted, secure, or error-free
• The results from using our services will be accurate or reliable
• The quality of any content or interactions will meet your expectations
• Any errors in the service will be corrected

You use our services at your own risk. We make no warranties about the conduct of other users.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Personal injury or emotional distress
• Damages arising from interactions with other users
• Any content posted by third parties

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Muslims After Midnight, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your misuse of our services
• Your violation of any law or rights of a third party

12. Privacy & Data Protection

By using our services, you consent to our data practices as described in these policies.

13. Account Termination

By You: You may delete your account at any time from your settings or by contacting support.

• Engage in prohibited activities (see Section 5)
• Harass, abuse, or threaten other users
• Post sexual or romantic content
• Create fake profiles or engage in fraud
• Attempt to harm our systems or users

Consequences of Termination:

• Access to your account will be disabled
• Your profile will be removed
• Data will be deleted within 30 days
• No refunds for premium subscriptions (except as stated in Refund Policy)

14. Governing Law

These Terms shall be governed by the laws of Alberta, Canada and applicable federal laws of Canada.

Any disputes shall be resolved in the courts of Alberta, Canada. You consent to the exclusive jurisdiction of such courts.

15. Changes to Terms

We may update these Terms of Service from time to time. Changes will be effective:

• Immediately for new users
• 30 days after posting for existing users (unless otherwise required by law)

We will notify you of significant changes by:

• Sending an email to your registered address

Your continued use after changes become effective constitutes acceptance of the new terms.

16. Severability

These Terms, together with our Privacy Policy, Cookie Policy, and Community Guidelines, constitute the entire agreement between you and Muslims After Midnight regarding your use of our services.
